menus not showing up?

I'm running grim fandango in windows xp under windows 98 compatibility mode. whenever I press F1, nothing shows up except for the game title. I managed to navigate to some invisible menu with bars and was able to turn on (or maybe off) hardware acceleration because i was having other graphical issues... but i still can't see any of the options on the menu and its really annoying.

 

anyone have any ideas?

 

also, I tried the patch but i kept getting that windows error message asking if i wanted to send an error report.
