teleguy
Thats probably because you have a British keyboard layout. Try the key above the tab key.

JediMouse
You may have to specifically enable the key bind for the console. Look in your jk2mp(and sp for single player).cfg with a text editor, like Windows' Notepad. Try to find an entry for (I think the command is) displayconsole (can someone check this command for me -- I'm at work and do not have the game in front of me). If it's not there, add in somewhere a new key bind (the same format as the others) such as 'bind ~ displayconsole' (without quote marks). This will enable the console when you press the tilde key, as it should be. Be careful editing these files; this is not the normal or recommended method of setting key binds, but it's the only place to do it for the getting the console to display. Don't screw with anything else in these files! Be careful, and have fun! ~JediMouse~
