I don't believe that that sort of thing has ever been done without the mod team's permission. If it had been, I imagine we would have heard about it. If LEC claimed they made a popular mod made by, a guy called JediBob100, people would know JediBob100 made the mod, and if LEC tried to take credit for it, well, that would be just damn stupid... Yeah, like I stated before. The courts have determined that those things aren't enforceable. A. There's no benefit for agreeing to the "contact". You can't normally sign away your rights without SOME sort of reembersment. (Used the said product isn't considered a benefit.) B. It's not up front. You only see the agreement after d/ling or buying the product. (The "you can only open this safe if you agree to the contact inside" situation) God knows why they even have them anymore. It clearly says that by clicking "I Agree" and installing the software, you DO agree. It's right there IN FRONT of you. What more do you want? A big sign on the box with the entire EULA on it? Doesn't work that way pal. And your "You can only open this safe if you agree to the contract inside" thing is just... wrong. That isn't how it works. The whole EULA is shown to you BEFORE you install the software, not after. The thing with the editing tools may show it to you after, but notice how the agreement doesn't state "By installing" the software, it's on the basis of actual mod creation.
