You know - the legal jargon with the "Yes, I agree"-button that let's you continue installing the software... This is a serious poll, hence no "Yoda"-option. Still up in the air as to whether the EULA is valid, or that the contract is already complete at the time of sale.. (Everything else seems to have this as a legitimate closure of contract) Just because it's part of the install program doesn't make it binding, the installer/CD/etc is a method of delivery to use the purchased software. Stopped looking at them once it was mentioned in a law lecture that EULA's aren't necessarily enforceable, since it is more likely than not, with current precedents that a EULA will need to be placed on the outside of the box to be considered legally binding. I know this sounds stupid to some, but to purchase an item, to only find AFTERWARDS that they will place certain limitations on you is legally non-enforcable, just because every software program has one doesn't make it legal.... Luc Solar Posted January 23, 2003 Author Share Posted January 23, 2003 Who of you would f.ex. by a car ...without ever seeing and driving it? ...and pay (without any possibility of getting their money back) before reading through the contract 'cause the contract that says that you can not sell it to anyone or look under the hood in order to examine the engine or drive more than 20mph is located in the glove compartment of the car? The contract naturally also states that by opening the glove compartment you agree to all it's terms... If you have some useful info about these things, BCanr2d2, please pm me.
